Delphi Estates Development
Here is a brief description regarding information and status on the
Delphi Estates development:
The project proposes the construction of approximately 2 miles of private
road to serve 87 existing lots. The 87 lots were created through a
testamentary division. This property is located in Section 2, Township
17; Range 3W. The parcel numbers are 13702110400, 13702110500, 13702110600,
13702110700, 13702110800, 13701220201, and 1370211900. See maps below. The planned
roadway construction incorporates existing gravel roads that were installed
in early 1990's for logging purposes. All construction would commence
at an existing concrete bridge (25' wide) where Chelsea Lane crosses McLane
Creek.
The Delphi Estates development used a law called the Testamentary Division. The law was
enacted to allow an owner of a minimum lot size to divide the lot between
the
children when he or she died. The Delphi Estates acreage was divided into seven
parcels, each under 20 acres, which puts them below the building
moratorium. The Delphi Estates has used the Testamentary Division law
to further divide acreage without going through the Thurston County plat
division process. As a result the Delphi Estates has been divided into lots
as small as one half acre. This is a direct violation of the spirit of
the law, but does not violate the letter of the law. Because of the way the
law was written, The Delphi Estates could not be denied this development. This land was
originally zoned for five acre lot sizes since it is next to the Capital
Forest and
was to have minimum impact on the wild life there.
It is important to have the Delphi Association monitor this development
for it's impact on the community. Traffic, water, noise and other issues
are of vital concern as this project proceeds.
